CA Prop 65 Warning

California Proposition 65 – FAQ

  • Why is this warning shown on products?

Products that may expose someone to any chemical listed under California Proposition 65 must provide a warning unless the business can demonstrate that exposure is below the State’s “no significant risk” threshold.

Because electronic devices commonly use materials and components that can include one or more listed substances, manufacturers and retailers may include the warning to support compliance and transparency.

  • How can I trust that products are safe? (Garmin Specific)

With Garmin products, exposure levels may be well within the State of California’s defined “no significant risk” range. However, Proposition 65 requires a warning unless a company specifically demonstrates that exposure falls below that threshold.

The State of California explains: “The fact that a product bears a Proposition 65 warning does not mean by itself that the product is unsafe.”

The State also notes that Proposition 65 can be viewed as a “right to know” law rather than a pure product safety law. The warning is intended to help consumers make informed purchase decisions.

  • What is California Proposition 65?

California Proposition 65, officially the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide a warning if a product may expose someone to chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm.

The State maintains and updates a list of these chemicals annually. The list includes substances that may be present in many common consumer products, including certain electronic components.

  • What does “no significant risk” mean?

For chemicals listed as carcinogens, “no significant risk” is defined by California as a level that would result in not more than one additional case of cancer in 100,000 individuals exposed over a 70-year lifetime.

For reproductive toxicants, the threshold is set at levels significantly below those shown to cause observable reproductive harm in studies.
